We are pleased to offer the services described herein for your personal use and enjoyment, subject to the terms and conditions set forth herein (the “Terms of Use”). You are hereby advised to read the Terms of Use carefully prior to accessing or using the CATCHPLAY+ Services (as defined below), through compatible internet-connected devices (each a “Compatible Device”). References to other terms, documents, sources, policies, and materials, including without limitation, the Privacy Policy, Copyright Notice, and Plan Policy, are incorporated by reference into the Terms of Use and form an integral part thereof.
1. THE SERVICE
a. Overview: CATCHPLAY+ is the proprietary Over-The-Top (OTT) service owned and operated by AsiaPlay Taiwan Digital Entertainment Ltd., offering users access to a curated selection of digitized movies and television series (collectively, the “Content”). This service, including all features, functionalities, websites, user interfaces, content and associated software, is collectively referred to as the “CATCHPLAY+ Services”. The CATCHPLAY+ Services permit authorized users to stream the Content through various access point, including the CATCHPLAY+ website, application, distribution platforms of authorized third-party partners (each, an “Access Point”.)
b. Deemed Acceptance: By visiting the CATCHPLAY+ website or accessing the CATCHPLAY+ Services through any Access Point, you affirm your acceptance of and agreement to be bound by the Terms of Use and any applicable end-user license agreements.
c. Amendment: We reserve the right to amend, modify, or update the Terms of Use from time to time, in our sole discretion, without prior notice. For instance, we may amend the Terms of Use due to operational needs or changes in law and regulations. Amendments shall become effective immediately upon their posting on the CATCHPLAY+ website. Continued use of the CATCHPLAY+ Services following such posting shall constitute your acceptance of the modified Terms of Use.
2. CONDITIONS
a. Eligibility: Individuals under the age of 18, or the applicable legal age of majority in the relevant jurisdiction, may not register for the CATCHPLAY+ Services without the prior consent of a parent or legal guardian. If you are a minor, your act of registration represents that you have obtained all necessary consent, or that your use of the CATCHPLAY+ Services online constitutes a legally permissible act for a minor of your age and status under the laws of your jurisdiction.
b. License and Permitted Use: The CATCHPLAY+ Services and any Content accessed thereon are provided solely for personal, non-commercial use. Subject to an active subscription, we hereby grant you a limited, non-exclusive, non-transferable, and revocable license to access and stream the Content via Compatible Devices for personal use. No rights, title, or interest in the Content or the CATCHPLAY+ Services shall be deemed granted to you except for the aforementioned limited license.
c. Territorial Restrictions and Availability: Content shall be accessible solely within the country in which your account is registered and only in jurisdictions where we hold the legal rights to distribute such Content. The availability of download functionality, supported subtitle languages, and dubbed versions for the Content shall be subject to the respective licensing terms and conditions imposed by the applicable rights holders and is subject to geo-location verification mechanisms. Limitations on simultaneous streams and permitted devices are set forth in your account settings under the "My Account" section and may be subject to change at our sole discretion.
d. Service Modifications and Testing: We reserve the right to modify, update, test, or otherwise alter any aspect of the CATCHPLAY+ Services at any time, including but not limited to Content, websites, applications, functionalities, promotional offerings, pricing structures, and user interfaces, without prior notice. By continuing to use the CATCHPLAY+ Services, you acknowledge and consent to such changes. We may, without prior notice, include you in or exclude you from the aforementioned tests, and we reserve the right not to disclose the nature of such test programs and to modify the test content at any time.
e. Prohibited Use: You agree to use the CATCHPLAY+ Services in strict compliance with all applicable laws, rules, regulations, and any other restrictions governing the use of the CATCHPLAY+ Services or Content. Any unauthorized reproduction, adaptation, modification, editing, distribution, publicly transmission, decompilation, reverse engineering, or other forms of use or exploitation, whether in whole or in part, is strictly prohibited without our prior written consent.
f. Restrictions on Access and Interference: You shall not: (i) circumvent, remove, alter, deactivate, degrade, or otherwise interfere with any content protection mechanisms; (ii) use any robot, spider, scraper, or other automated means to access the CATCHPLAY+ Services; (iii) decompile, reverse engineer, or disassemble any part of the CATCHPLAY+ Services; (iv) insert any code or manipulate the CATCHPLAY+ Services in any manner; or (v) employ data mining, data gathering, or extraction techniques. You further agree not to upload, post, transmit, or otherwise send any material that contains software viruses or other code designed to interrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment associated with the CATCHPLAY+ Services.
g. Streaming Quality and Technical Requirements: The availability and quality of Content, including HD, Full HD, and Ultra HD, may vary by region and are contingent upon your device capabilities and internet service. Not all Content is available in all formats or plans. The following download speeds per stream are recommended: (i) HD (720p or higher): 10.0 Mbps; (ii) Full HD (greater than 1080p): 25.0 Mbps; and (iii) Ultra HD (greater than 3840p): 50.0 Mbps and a device conforming to CATCHPLAY+’s Ultra HD quality requirements. You are solely responsible for all Internet access fees. Please consult your Internet service provider for details regarding data usage charges. We may no warranties regarding the quality of playback on your device, and startup times for streaming may vary based on your location, network conditions, selected Content, and device configuration.
h. Software and Device Responsibility: The software or applications used in connection with the CATCHPLAY+ Services are developed by us or commissioned by us to be developed for the CATCHPLAY+ Services, for the purpose of enabling the streaming of Content to Compatible Devices via the CATCHPLAY+ Services. To use the CATCHPLAY+ Services on your device, you may be required to install certain software or applications. You agree to receive notifications of, and install in accordance with the instructions provided, updated versions of the CATCHPLAY+ Services and any related third-party software, so that we may continue to provide you with optimal service quality. Recommended devices and software specifications are set forth in the “FAQ” section. If the device you use to access the CATCHPLAY+ Services is sold, lost, or stolen, you must promptly log out of or deactivate the device via the “My Account” section. Failure to do so may result in subsequent users accessing the CATCHPLAY+ Services through your account, obtaining access to certain account information, or incurring additional charges. Please follow the instructions in the “My Account” section to log out of such devices and update your personal login credentials.
i. Termination and Restriction of Use: We reserve the right, at our sole discretion and without notice or compensation, to suspend, restrict, or terminate your access to the CATCHPLAY+ Services if you are found to be, or are suspected of being, in breach of the Terms of Use or engaged in any unlawful or improper conduct.
j. Content Classification and User Discretion: You agree to view the Content in accordance with the film classification laws and regulations of your country or region, and to comply with the age restrictions indicated for the Content provided through the CATCHPLAY+ Services. You acknowledge that you may encounter Content deemed offensive, indecent, or objectionable, which may or may not carry appropriate warnings. You access such Content at your sole risk, and we disclaim all liability in connection therewith. Content categories and descriptions are provided solely for your convenience and may not be accurate. For users located in Singapore, minors under the age of 18 are strictly prohibited from viewing R-rated Content. Viewing of G, PG, or PG-13 Content requires the presence and supervision of a parent or legal guardian, in accordance with applicable regulations.
k. Intellectual Property Rights: All videos and Content available on the CATCHPLAY+ website and application, including but not limited to audiovisual works, video materials, graphics, textual information, site architecture, programming code, webpage layout and design, music, software, sound recordings, and proprietary technology, are our intellectual property or are lawfully licensed to us. These assets are protected under applicable laws, including but not limited to copyright, trademark, patent, and trade secret laws. Your use of the CATCHPLAY+ Services does not convey any ownership rights in any aspect of the CATCHPLAY+ Services.
3. REGISTRATION, ACCOUNT AND PASSWORD
a. Registration: In order to stream and view certain Content via the CATCHPLAY+ Services, you are required to register for an account and read and agree to the Terms of Use and Privacy Policy. Should you elect to register for an account at any time, the additional terms and conditions set forth in this Section shall apply in full.
b. Account: The individual who creates an account with us and whose designated payment method is charged shall be referred to as the “account holder.” The account holder shall retain primary access to and control over the account, which shall be exercised through the use of a password. To maintain such exclusive control, the account holder must not disclose its password to any third party. Furthermore, to safeguard against unauthorized changes to account control, the account holder should not disclose any associated payment method details (including, but not limited to, the last four digits of a credit or debit card, or contact information such as email address or phone number used for micropayment) to any other party.
The account holder shall be solely responsible for all usage of the account, including usage by members of the account holder’s household. By permitting others to access the account, the account holder acknowledges and agrees to be responsible for ensuring compliance with the Terms of Use and accepts full liability for its activity conducted through the CATCHPLAY+ Services.
Notwithstanding the foregoing, you acknowledge and agree that your account is intended solely for personal, non-commercial use and is restricted to members of your household. You may not share, distribute, sell, rent, or otherwise transfer your account credentials to any third party. Any unauthorized use of the CATCHPLAY+ Services, including but not limited to account sharing outside your household, resale, or commercial exploitation of your subscription, is strictly prohibited. We reserve the right to take any action we deem appropriate, including without limitation suspending or terminating your account and initiating legal proceedings, to address and prevent any violation of the Terms of Use.
c. Password: You understand and acknowledge that, in order to facilitate convenient access to your account and to assist in the administration of the CATCHPLAY+ Services, we may implement technology that enables us to recognize you as the account holder and provide direct access to your account without requiring you to re-enter your password or other identifying credentials when accessing the CATCHPLAY+ Services via Compatible Devices or our website. You are responsible for maintaining the confidentiality of your password and should never disclose it to any representative of the CATCHPLAY+ Services. Because you are responsible for all activities conducted under your account, including unauthorized access by third parties, you must take reasonable steps to safeguard your account credentials. In the event you become aware of or suspect any unauthorized use of your account, you must notify our Service Center via email to support@catchplay.com immediately. Additionally, please ensure that your registration information remains accurate and up to date so that we may contact you when necessary.
d. Sensitive Account Information: You should exercise caution when responding to any communication that requests the submission of credit card or other account-related information. Responding to such communications may result in identity theft. To protect your information, always access your account directly by visiting the official CATCHPLAY+ websites, and never through hyperlinks contained in emails or electronic messages, even if they appear to be from us.
We are aware of fraudulent communications falsely claiming to be from our representatives, including emails that may reference alleged policy violations and request that users open attached files or click on links. These communications are malicious and may contain phishing links, viruses, or other harmful content. Do not open any unexpected attachments or respond to such messages. We do not send unsolicited notices or legal claims via email with attachments. If you receive a suspicious communication, please contact our Service Center via email to support@catchplay.com to verify its authenticity. We shall not be liable for any acts conducted or damages incurred by you in connection with or as a result of your accessing or engaging with platforms or services external to the CATCHPLAY+ Services.
4. SUBSCRIPTION, BILLING AND CANCELLATION
a. Subscription: It is our goal to offer users a broad range of viewing options. To this end, we offer subscription-based access to the CATCHPLAY+ Services, which includes Content that would not otherwise be available without payment of a subscription fee. You may review the specific details of your subscription plan at any time by logging into your account on the CATCHPLAY+ website and accessing the "My Account" section. You acknowledge and agree that your CATCHPLAY+ account is intended for individual use only. You further understand that, due to licensing restrictions and/or technical limitations imposed by third-party providers, certain Content may be accessible through one Access Point but not through another.
b. Movie Fans Membership:
i. Overview: The ‘MOVIE FANS’ membership is our basic membership. As a member, you are entitled to view 1 movie from the designated ‘FREE’ section every month. Upon initiating playback of any selected title, you agree to complete viewing within 48 hours. No refunds, credits, or compensation shall be provided for partially viewed or uncompleted titles.
ii. Fees: There is no fee associated with the MOVIE FANS membership. However, the membership does not include any Internet service costs. You are solely responsible for any data or Internet service charges incurred, and we recommend consulting your Internet service provider for details.
iii. Renewal and Termination: The MOVIE FANS membership automatically renews on a monthly basis at no cost, unless and until it is terminated by you or by CATCHPLAY+ in accordance with our Terms of Use.
iv. Device Access: Your membership permits registration of up to 5 individual devices. Concurrent streaming is allowed on up to 2 devices per account at any given time.
v. Streaming: Our Content is delivered exclusively via streaming and is not available for download. To access Content, you must maintain an active Internet connection throughout the duration of your viewing session and be located within Singapore.
vi. Supported Devices: CATCHPLAY+ is compatible with the following platforms and operating systems – PC/Mac: Chrome version 83 or above, Safari version 13 or above; iOS and Apple TV app: iOS 12.0 or above; Android and Google-certified Android TV app: Android 6.0 or above; LG Smart TVs: webOS 4.0 or above. For detailed specifications regarding support for Smart TVs, set-top boxes, Chromecast, or AirPlay, please refer to the FAQ section on our website.
vii. Internet Requirements: A minimum broadband connection of 10 Mbps is recommended for optimal streaming quality. Your viewing experience may vary depending on device capabilities, bandwidth availability, network congestion, and geographical location. To ensure smooth playback, CATCHPLAY+ may dynamically adjust video resolution and bit rate.
viii. Content Classification: All Content on CATCHPLAY+ is rated in accordance with applicable local laws and regulations. You are responsible for ensuring that Content selected for viewing is age-appropriate.
ix. Miscellaneous: We reserve the right to modify content offerings, pricing structures, payment methods, and other terms relevant to the MOVIE FANS membership. Please consult our website for the most up-to-date information.
c. Single Rental
i. Viewing Period: You must begin watching the selected movie within 30 days from the time of purchase. Once playback has commenced, you will have 48 hours to complete viewing before the rental period expires. Unused or partially viewed rentals will not be refunded or extended.
ii. Supported Devices: CATCHPLAY+ is compatible with the following platforms and operating systems – PC/Mac: Chrome version 83 or above, Safari version 13 or above; iOS and Apple TV app: iOS 12.0 or above; Android and Google-certified Android TV app: Android 6.0 or above; LG Smart TVs: webOS 4.0 or above. For detailed specifications regarding support for Smart TVs, set-top boxes, Chromecast, or AirPlay, please refer to the FAQ section on our website.

vi. Streaming: Our Content is delivered exclusively via streaming and is not available for download. To access Content, you must maintain an active Internet connection throughout the duration of your viewing session and be located within Singapore.
vii. Content Classification: All Content on CATCHPLAY+ is rated in accordance with applicable local laws and regulations. You are responsible for ensuring that Content selected for viewing is age-appropriate.
viii. Miscellaneous: We reserve the right to modify content offerings, pricing structures, payment methods, and other terms relevant to Single Rental. Please consult our website for the most up-to-date information.
d. MOVIE LOVERS Membership
i. Overview: As a member, you enjoy unlimited access to all Content in the ‘SUBSCRIPTION’ section for the duration of your active membership, subject to content availability and applicable age classification.
ii. Fees: Membership fees are listed on our website and exclude GST and any Internet service costs. You are solely responsible for any data or Internet service charges incurred, and we recommend consulting your Internet service provider for details.
iii. Renewal and Cancellation Policy: Your MOVIE LOVERS membership will automatically renew on a monthly basis until it is cancelled. Starting from the second month of subscription, the recurring billing date for the account will be determined by the day following the initial subscription date. For instance, if the account’s initial subscription date is March 12, the billing date for each subsequent month will be on the 13th day of that month, and so on. To avoid service interruption, you must maintain a current, valid, and accepted method of payment, which you may update at any time via the “My Account” section on our website. You may cancel your subscription at any time. Your membership will remain active through the end of your current billing cycle, and we do not offer refunds or credits for unused periods or unwatched Content. Upon cancellation, your membership will automatically revert to the free MOVIE FANS tier at the end of your paid period.

e. Recurring Billing: By initiating a subscription to the CATCHPLAY+ Services (e.g., 30-day, 90-day, 180-day, or 360-day plans, as applicable) and providing an accepted payment method (including credit card or micropayment account), you acknowledge and expressly agree to recurring charges. These charges will be automatically processed according to your selected subscription interval unless and until you cancel your subscription, or unless your account is suspended or terminated by us. The amount billed per period may vary due to promotional offers, changes to your subscription plan, the Content offering, and/or applicable taxes. You authorize us to charge your payment method accordingly.
f. Price Change: We reserve the right to adjust the pricing of the CATCHPLAY+ Services or any component thereof at our sole discretion and at any time. For monthly membership plans, unless expressly stated otherwise in the Terms of Use, any changes to the pricing of the CATCHPLAY+ Services shall take effect from the billing cycle immediately following the announcement of such changes. If you do not agree with the revised pricing, you may cancel your subscription at any time. Continued use following notification will constitute your acknowledgement and acceptance of the new pricing.
g. Cancellation: You may cancel your subscription at any time by logging into the CATCHPLAY+ website and navigating to “My Account” ???? “Plan Details”. Upon successful cancellation, you will retain access to the Content until the conclusion of the current billing cycle. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR PARTIAL SUBSCRIPTION PERIODS OR FOR UNWATCHED MOVIES OR PROGRAMS. If your subscription is on a recurring billing cycle, you must cancel your subscription at least 72 hours prior to the end of the current billing cycle. Where purchase is made through a third-party partner, if you wish to cancel your subscription, including during any free trial period, you may be required to do so directly through the relevant third-party partner. For example, this may involve visiting your account settings with the applicable third-party partner and turning off auto-renewal or unsubscribing from CATCHPLAY+ through their platform. You may also access billing and subscription information for your CATCHPLAY+ account by logging into your account with the respective third-party partner.
h. No Refund: ALL PAYMENTS ARE NONREFUNDABLE. NO REFUNDS OR CREDITS WILL BE ISSUED FOR PARTIAL USE OF SERVICES. Upon cancellation, you will retain access to the CATCHPLAY+ Services until the end of your current billing period. In rare instances and at our sole discretion – such as a prolonged technical outage – we may issue credits. The issuance, amount, and form of any such credit shall be determined solely by us and does not create any obligation or precedent for future credits.
i. Payment Updates: If we and/or our third-party partner is unable to charge your payment method for subscription fees due to insufficient funds, expired or invalid account details, or any other reason, you remain responsible for the outstanding charges. Any change to your payment method may affect your billing cycle. You are solely responsible for ensuring that your Payment Method details are accurate and up to date. If your payment method cannot be successfully charged, we and/or the relevant third-party partner reserve the right to suspend or terminate your subscription and access to the CATCHPLAY+ Services until a valid payment method has been provided and payment is successfully processed.
j. Promotions: We may occasionally offer promotional codes, including those distributed through third-party promotions. Redemption of such codes shall be subject to the specific terms of the promotion. Promotional codes are non-transferable, cannot be redeemed for cash, and may only be used once. They may be combined with other offers, including free trials, subject to restrictions imposed by us at our sole discretion. If your code is obtained via a third party, additional terms may apply. Before redeeming a promotional code, ensure that no active subscription plans exist under your account or that existing plans have been properly canceled. If multiple plans are activated simultaneously under the same account, and one of the plans takes effect immediately, both plans will remain active concurrently until the earlier of the following: the expiration of one plan’s billing cycle or your cancellation of either plan. Only upon the occurrence of such an event will the dual-plan status be resolved. Exceptions to the foregoing may apply depending on the payment method selected by you. During the period in which both plans are active, a single-rental voucher corresponding to each plan will be automatically credited to your account. Each voucher must be redeemed within the validity period of its respective subscription plan. Failure to redeem the voucher within such period shall be deemed a forfeiture of the right to redeem, and no deferral, extension, or compensation will be provided.
i. Billing Party: We may, at our sole discretion and at any time, engage third-party service providers to act as the billing party responsible for processing payments and managing billing-related matters. During the sign-up process, you may be offered the option to select a payment method facilitated by one of our authorized third-party partners via the CATCHPLAY+ application. If you choose to subscribe to CATCHPLAY+ using a payment method linked to your account with such third party, your subscription and payment processing will be governed by the terms of use and privacy policy of that third party. In such cases, all payment information provided will be processed directly by the third party and not by us. Accordingly, any billing inquiries, including those concerning transaction records or payment issues, should be directed to the respective third-party billing provider. You are solely responsible for all charges incurred under your subscription. By selecting a third-party billing option, you acknowledge and agree that any questions or disputes regarding your billing or invoices must be addressed directly with the billing party. If you access the CATCHPLAY+ Services via iOS or Android applications, your use is also governed by the applicable App Store or Google Play Terms of Service, in addition to the Terms of Use set forth herein. You acknowledge and agree that Apple and/or Google are third-party beneficiaries of the Terms of Use. Upon your acceptance of the Terms of Use, Apple and/or Google shall have the right (and shall be deemed to have accepted the right) to enforce the Terms of Use as third-party beneficiaries.
5. COLLECTION AND USE OF PERSONAL DATA AND OTHER INFORMATION
a. Use of Feedback: You acknowledge and agree that we are free to use, without restriction or compensation to you, any comments, information, ideas, concepts, reviews, techniques, or any other material contained in any communication you submit to us (collectively, "Feedback"), including without limitation responses to questionnaires, surveys, or posts made through the CATCHPLAY+ Services, including the CATCHPLAY+ website and user interfaces. Such use includes, without limitation, the reproduction, publication, display, transmission, modification, development, manufacture, marketing, and improvement of products or services. You grant us a worldwide, perpetual, irrevocable, sublicensable, and transferable right to use such Feedback for any purpose, without further acknowledgment or payment to you. To the extent permitted under applicable law, you also agree not to assert or enforce any "moral rights" or similar rights in the Feedback that may limit our use of such material.
b. Unsolicited Submission: Please note that we do not accept or consider unsolicited creative ideas, suggestions, scripts, concepts, or other materials relating Content. You acknowledge and agree that we are not responsible for any similarity between any part of our Content and any unsolicited materials or ideas that you may submit. If you do send us such unsolicited materials or ideas, you do so with the understanding that (i) no additional consideration will be provided to you, and (ii) you waive any claim against us and our affiliates regarding the use of any such materials or ideas, including any similarities to materials or ideas already in use.
c. Privacy Policy: For information about our policies and practices regarding the collection and use of your personal data and other information, please refer to our Privacy Policy. The Privacy Policy is incorporated by reference into the Terms of Use and forms an integral part thereof. By accepting the Terms of Use, you also agree that your use of the CATCHPLAY+ Services, including through any Access Point, is subject to the Privacy Policy in effect at the time of your use.
6. COMMUNICATION PREFERENCES
a. Transactional Communications: By using the CATCHPLAY+ Services, you consent to receive electronic communications from us relating to your account. These communications may include emails sent to the email address you provided during registration, or messages posted on the CATCHPLAY+ Services, and may cover matters such as payment authorizations, password changes, confirmation notices, and other transactional or account-related information. These communications are considered part of your relationship with us. Please note that we reserve the right not to retain your watch history or order information that is older than 12 months from the date you access your account information. Marketing and Promotional Communications: You also consent to receiving certain non-transactional communications from us, including newsletters, updates about new CATCHPLAY+ features or Content, promotional announcements, special offers, and customer surveys, via email or other communication methods. 7. INTELLECTUAL PROPERTY
a. Copyright: All videos and Content available on the CATCHPLAY+ website and application, including but not limited to audiovisual works, video materials, graphics, textual information, site architecture, programming code, webpage layout and design, music, software, sound recordings, and proprietary technology, are our intellectual property or are lawfully licensed to us. These assets are protected under applicable laws, including but not limited to copyright, trademark, patent, and trade secret laws. We hold the legal rights to publicly transmit, broadcast, publish, and distribute all such Content. All rights are hereby expressly reserved. Any unauthorized reproduction, adaptation, modification, editing, distribution, publicly transmission, decompilation, reverse engineering, or other forms of use or exploitation, whether in whole or in part, is strictly prohibited without our prior written consent. The Terms of Use do not grant you any ownership or proprietary rights in any intellectual property belonging to us and/or our licensors, whether in the Content or the CATCHPLAY+ Services. Your right to use such intellectual property is limited solely to the personal and non-commercial purpose of viewing movies and/or programs via the CATCHPLAY+ Services, in accordance with the Terms of Use.
b. Trademarks: CATCHPLAY, CATCHPLAY+, the CATCHPLAY+ logo, and all related marks, graphics, logos, scripts, and sounds are trademarks or service marks owned by us. These marks may not be copied, downloaded, used, reproduced, or otherwise exploited in any manner without our prior written authorization.
8. DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY
a. Disclaimer of Warranties: The CATCHPLAY+ Services, including all Content, software, and any features or functionalities associated therewith, are provided on an “as is” and “as available” basis, with all faults and without warranty of any kind. To the extent permitted under applicable law, CATCHPLAY+ expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any guarantees regarding uninterrupted or error-free use of the CATCHPLAY+ Services. We do not guarantee, represent, or warrant that your use of the CATCHPLAY+ Services will be uninterrupted, timely, secure, or error-free. We specifically disclaim any liability arising out of, related to or in connection with the use of applications, Compatible Devices, or CATCHPLAY+ software, including but not limited to their continued compatibility with the CATCHPLAY+ Services.
b. Indemnity: You agree to indemnify, defend, and hold harmless us, our subsidiaries and affiliates, our and their respective shareholders, directors, officers, employees, agents, representatives, and licensors from and against any and all claims, liabilities, losses, damages, expenses, and costs (including legal fees) arising out of or in connection with: (i) your use or misuse of the CATCHPLAY+ Services; (ii) your violation of the Terms of Use or any applicable law or regulation; (iii) your infringement of any intellectual property or other right of any third party; and (iv) any content you submit, post, or transmit through the CATCHPLAY+ Services.
c. Limitation of Liability: To the extent permitted under applicable law, in no event shall we, our subsidiaries and affiliates, our and their respective shareholders, directors, officers, employees, agents, representatives, and licensors be liable to you for: (i) any indirect, incidental, special, punitive, or consequential damages of any kind; (ii) any loss of profits, revenue, data, use, goodwill, or other intangible losses; (iii) damages resulting from your breach of the Terms of Use; (iv) damages arising from your access to or use of the CATCHPLAY+ Services, or inability to do so; (v) damages due to any unauthorized use of your account; (vi) delays, interruptions, or limitations experienced while viewing content; (vii) any claims arising from your violation of third-party rights; or (viii) for any other matters whatsoever arising from, related to or in connection with your use of the CATCHPLAY+ Services. To the extent permitted under applicable law, our aggregate liability for any claim arising out of or relating to the Terms of Use shall not exceed the total subscription fees actually paid by you in the 12 months preceding the event giving rise to such claim.
d. Non-waivable Rights and Severability: Nothing in the Terms of Use shall affect any non-waivable statutory rights to which you may be entitled under applicable law. If any provision of the Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
9. GOVERNING LAW AND DISPUTE RESOLUTION
a. Governing Law: The Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore without regard to its conflict of laws principles.
b. Dispute Resolution: Any dispute, controversy, difference, or claim arising out of or relating to the Terms of Use – including their existence, validity, interpretation, performance, breach, or termination – shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the SIAC Arbitration Rules for the time being in force, which rules are deemed to be incorporated by reference into this clause. The seat of arbitration shall be Singapore, and the language of arbitration shall be English. The arbitration shall be conducted by a sole arbitrator. The arbitral tribunal shall state the reasons for its decision in writing and shall not render any award based on the principles of ex aequo et bono or as amiable compositeur. The arbitral award shall be final and binding on both parties.
10. ISCELLANEOUS
a. Service Suspension or Termination: We may temporarily or permanently change, suspend, or discontinue all or part of the CATCHPLAY+ Services (including Content and supported devices) at any time, at our sole discretion. We may or may not notify users depending on the nature of the change. For non-paid services (e.g., free viewing or platform support changes), notifications are at our discretion. For paid subscription plans, we will notify you in advance of changes. You hereby acknowledge and consent that we shall bear no liability whatsoever to you in connection with any modification, suspension, or termination of the CATCHPLAY+ Services. In some exceptional cases, we may offer compensation such as discounts, refunds, or extended service time. However, if your access is restricted or terminated due to abuse or violation of the Terms of Use, you will not be entitled to any compensation, and access may be revoked without prior notice.
b. Use of Third-Party Applications: If you access CATCHPLAY+ Services through third-party applications (e.g., websites, software, or other platforms), your use of those applications may be subject to the third party’s own terms of use or license agreements.
c. Customer Support: For more information about the CATCHPLAY+ Services and features, or if you need help with your account, please visit “Support Center” on our website or contact us via email to support@catchplay.com. In some cases, the Support Center may offer support through a remote access tool, which would allow full access to your computer. If you do not wish to grant this access, simply decline the remote support option, and we will assist you through alternative methods. In the event of any conflict between the Terms of Use and information provided by the Support Center or elsewhere on our website, the Terms of Use shall prevail.
